 "It's a complete victory for the church," said Derek Gaubatz, director of litigation for the Becket Fund for Religious Liberty, which represented Living Faith. "The church got everything they've asked for; they're going to be able to continue to worship there."

Gaubatz said he was confident Living Faith would be held up as an example.

"We hope this case will be a good lesson for local governments around the country that the Constitution doesn't give them unfettered law to take the property of churches in the name of economic development," he said. "This is a good example of the First Amendment bringing the local government to the bargaining table."
