CO Court Allows Rocky Mountain Christian Church Case to Proceed

On March 30, 2007, Judge Robert E. Blackburn of the District of Colorado denied all but two claims of the defendant's motion to dismiss in the case of Rocky Mountain Christian Church v. Board of County Commissioners of Boulder County, CO, in the Church's (RMCC) continuing battle to expand its facilities to accomodate a growing congregation. 

Judge Blackburn ruled that RMCC may go forward with its claim that by denying RMCC a special-use permit the County violated the First Amendment and equal protection rights, as well as the Religious Land-Use and Institutionalized Persons Act (RLUIPA).  The Church applied for the special-use permit in order to expand its facilities on property it owns in Boulder County.
